Two Taiwanese men, Cheng Ming Hung and Hsueh Chun Ta, appeared in the Kuala Lumpur Sessions Court and pleaded not guilty to three charges related to firearm trafficking and possession. The charges stem from an alleged incident on January 16th where the accused were accused of trading 14 pistols and one submachine gun barrel without proper authorization.
Two Taiwanese men pleaded not guilty to three charges of firearm trafficking and possession of 900 rounds of ammunition at the Kuala Lumpur Sessions Court yesterday. For the charge involving firearm trading, the accused, Cheng Ming Hung, 26, and Hsueh Chun Ta, 33, were accused of trading 14 pistols and one submachine gun barrel without lawful authorization. The act was allegedly committed on January 16 last, at 5.30 pm at a house in Desa ParkCity, Sentul.
The charge was brought under Section 7(2) of the Firearms (Increased Penalties) Act 1971 and read together with Section 34 of the Penal Code which provides for a sentence of imprisonment of between 30 and 40 years and may be imposed with six strokes of the cane. Meanwhile, both accused were also charged with possessing a replica firearm in the form of a 'five-seven MK2P' pistol replica along with two empty bullet casings without lawful reason in an almirah at the house, at the same time, date and place. The charge was brought under Section 36(1) of the Dangerous Weapons Act 1960 and read together with Section 34 of the same act which provides for a sentence of imprisonment of not more than one year or a maximum fine of RM5,000 or both. In addition, for the charge involving firearm possession, Ming Hung and Chun Ta were accused of possessing 14 pistols, one submachine gun barrel and 900 rounds of ammunition without lawful authorization at the same time, place and date. The charge was brought under Section 8(a) of the Firearms (Increased Penalties) Act 1971 and read together with Section 34 of the Penal Code which carries a sentence of imprisonment of not more than 14 years and six strokes of the cane. The case was handled by Deputy Public Prosecutor, Nidzuwan Abd. Latip while both accused were not represented by lawyers. Judge Siti Shakirah Mohtarudin did not allow both accused to be granted bail on the grounds that this charge could not be guaranteed. The case is set for mention again on March 12
