OAKLAND — An Alameda County judge has ordered an Oakland man to stand trial in the killing of his own brother, court records show.
Jacinto’s attorney, Michal Tal, argued that the prosecution’s case fell far short of establishing a probable cause that Jacinto murdered Jacinto-Vicente, and said Jacinto seemed distraught over what Tal called a tragic accident. Reardon, though, said it would be “odd” to conclude that Jacinto-Vicente accidentally shot himself in the chest, which is where the bullet fatally struck him. He noted Jacinto initially told police he wasn’t at the scene of the shooting, then changed his story to call the shooting an accident that occurred after Jacinto-Vicente grabbed for a gun at Jacinto’s waistband.
