Operations are paused in Newry State Forest on the Mid North Coast following legal action launched on behalf of two Gumbaynggirr elders.
Legal action in the Land and Environment Court has led to a temporary halt to logging in a state forest that could form part of the proposed Great Koala National Park.Gumbaynggirr Elders have launched the action in a bid to permanently cease logging in the forestIn a statement, the NSW Forestry Corporation said it had voluntarily paused operations in Newry State Forest, near Urunga on the state's Mid North Coast, until the matter could be heard in the court in Sydney on Friday.
The court ordered Mr Marshall and Mr Jarrett be referred for pro bono legal assistance, and ordered the applicants to submit evidence to support the notice of motion, ahead of the matter returning to court for hearing on Friday. Gumbaynggirr Elder Herbert Marshall has taken action against the Forestry Corporation of NSW in the Land and Environment Court.
The documents also detailed a signed Voluntary Temporary Undertaking by the Forestry Corporation to suspend harvesting operations until 4pm on Friday.
"Our planning process for all operations includes consultation with the Aboriginal community and field surveys to identify and protect Aboriginal cultural heritage," the spokesperson said.Mr Jarrett said the action aimed to stop all logging operations in the Newry Forest."The totems of the Gumbaynggirr people are in danger — like the koala, like the greater glider," Mr Jarrett said.The matter is listed for hearing in the Land and Environment Court in Sydney on Friday.
