“I know of one member of the army whose employment arrangements, as in posted position, was adjusted based on consideration of the question in part whether Leahy Law issues may emerge.”The Leahy Laws prohibit the US from working with foreign forces implicated in human rights violations. US officials were concerned that continuing to work with Australian special forces could be a breach of US laws that prevent American assistance to foreign militaries where a unit has been accused of war crimes, including torture and extrajudicial killings, and wrote to General Campbell in March 2021.
“This is all centred on the question of whether a unit is regarded in some way as being tainted by this question of allegations of unlawful conduct.”“In circumstances where such questions don’t arise, there is no uncertainty about the continuing relationship between Australian and United States special forces.
