He says BN had wanted to ratify the statute but was advised by the then attorney-general that it may contravene the constitution.

PETALING JAYA: Najib Razak today said his government had once discussed acceding to the Rome Statute but was advised by the then attorney-general that the international treaty could contravene the Federal Constitution.

Thomas said this was why he had advised the Pakatan Harapan government to ratify the Rome Statute, saying it also had many advantages and it was difficult to argue against its ratification. “However, why did discussions by the BN government in March 2011 not lead to its ratification even seven years later until GE14?“This is because the BN government listened to and received advice from the attorney-general at the time that ratifying the Rome Statute could go against the constitution and the laws of our country,” the Pekan MP said.

Najib said his administration never signed any documents for Malaysia to accede to the statute when he was in power.
