Adam Tomison became tearful after being asked at the inquest into Cleveland Dodd 's death whether there was pressure to defend controversial conduct by the Department of Justice.
The former boss of WA's Department of Justice has broken down on the stand at the inquiry into the state's first juvenile death in custody, conceding that treatment of some juvenile detainees by the department was "institutional abuse". When asked whether he would deem previous treatment of juvenile detainees at Banksia Hill Youth Detention Centre — the state's main juvenile detention facility — as "child abuse", Dr Tomison replied: "I would deem it as institutional abuse.
It warned the department was breaching both state law and international obligations in its treatment of juvenile detainees at Banksia Hill. Dr Tomison agreed the show cause notice should have been "the straw that broke the camel's back" and he should have turned to the then-corrective services minister Bill Johnston for help earlier.Ultimately, the department made that decision seven months later when it created Unit 18 at the maximum-security, adult Casuarina Prison.
