The Federal Court in Malaysia confirmed the 35-year jail sentence and 12 strokes of the cane imposed on a former contractor, Noraizuwan Hamali, for the murder of six-year-old Muhammad Rayyan Hidayat Hairil Khan in 2018. While the prosecution's case relied on circumstantial evidence, the court ruled that Noraizuwan failed to raise reasonable doubt.
The Federal Court in Malaysia upheld the 35-year jail sentence imposed on a former contractor, Noraizuwan Hamali, for the murder of six-year-old Muhammad Rayyan Hidayat Hairil Khan in Perlis in 2018. The court also confirmed the 12 strokes of the cane sentence previously handed down. A three-man bench, comprising Court of Appeal president Tan Sri Abang Iskandar Abang Hashim and Federal Court judges Datuk Harmindar Singh Dhaliwal and Datuk Nordin Hassan, delivered the verdict.
Justice Abang Iskandar stated that while the prosecution's case relied heavily on circumstantial evidence, Noraizuwan failed to raise reasonable doubt against the prosecution's arguments. Noraizuwan had initially been sentenced to death by the High Court in 2022 for the killing of Muhammad Rayyan, the son of his then-girlfriend, at a house in Kampung Jejawi, Kangar, Perlis. Last year, the Appellate Court affirmed his conviction but commuted his death sentence to 35 years' imprisonment and 12 strokes of the cane. During today's Federal Court hearing, Noraizuwan's lawyer, Burhanudeen Abdul Wahid, argued that a 28-minute window existed during which the deceased was left unsupervised in the house while Noraizuwan went to pick up the child's mother from work. He suggested this raised the possibility of another person being responsible for the crime. He urged the court to overturn Noraizuwan's murder conviction, stating that there was no evidence directly linking him to the fatal injuries. Alternatively, he requested that Noraizuwan be convicted under Section 31 of the Child Act 2001 for child neglect. Deputy public prosecutor (DPP) Roshan Karthi Kayan countered that the High Court had already dismissed Noraizuwan's defense, which claimed the child's injuries were caused by a fall in the playground and bathroom. He emphasized that no one else was present in the house between 3.45 pm and 11.50 pm on the day of the incident, except for Noraizuwan and the deceased. DPP Kayan also pointed out that the deceased's mother affirmed there was only one house key, which was in Noraizuwan's possession. The prosecution did not appeal against the Court of Appeal's decision to commute Noraizuwan's death sentence to imprisonment.
