A Malaysian High Court will decide on February 19, 2024, whether to dismiss a lawsuit filed by a former assemblyman challenging the outcome of a by-election.
The High Court in Kuala Lumpur has set February 19, 2024, to deliver its decision on an application by the Election Commission (EC), Bersatu, and the Kelantan state assembly speaker to dismiss a lawsuit filed by former Nenggiri assemblyman Mohd Azizi Abu Naim. Justice Roz Mawar Rozain fixed the date after hearing arguments from both sides in a closed-door session on Wednesday (December 18).
Lawyer Chetan Jethwani represented Bersatu president Tan Sri Muhyiddin Yassin and party secretary-general Datuk Seri Hamzah Zainudin, while lawyer Awang Armadajaya Awang Mahmud acted for Kelantan Speaker Datuk Mohd Amar Nik Abdullah. Awang Armadajaya argued that the by-election for the Nenggiri state seat concluded on August 17, with Mohd Azmawi Fikri Abdul Ghani elected. He emphasized that Mohd Azizi, despite no legal barriers, chose not to contest the by-election. He further stated that Mohd Azmawi Fikri, as the elected candidate, has a right to be heard, as he stands to lose the most if the lawsuit succeeds. Awang Armadajaya requested the court to dismiss the lawsuit, deeming it without merit, frivolous, and potentially prejudicial to a fair trial.
