India's Supreme Court Threatens Legal Action Over AI-Generated Court Judgments

India's Supreme Court is threatening legal action against a judge for referencing AI-generated, fabricated judgments in a property dispute case. The court is investigating a lower court's decision in Andhra Pradesh after it was discovered the judge used AI-generated precedents. The Supreme Court views this as a serious threat to the integrity of the judicial process and has suspended the lower court's order.

NEW DELHI: Mahkamah Agung India mengancam mengenakan tindakan undang-undang terhadap seorang hakim yang didapati membuat keputusan dalam pertikaian hartanah dengan merujuk penghakiman palsu yang dijana kecerdasan buatan .

Mahkamah tertinggi itu, yang mendengar rayuan pihak defendan kini akan meneliti keputusan yang dibuat mahkamah rendah di negeri selatan Andhra Pradesh. Mahkamah menyifatkan kes itu amat membimbangkan dan menegaskan penghakiman palsu yang dijana AI mempunyai implikasi langsung terhadap integriti proses pengadilan. Masalah dalam kes di Andhra Pradesh bermula Ogos tahun lalu apabila seorang hakim sivil junior di mahkamah perbicaraan di Vijayawada mengeluarkan perintah dalam kes pertikaian hartanah. Mahkamah sebelum itu melantik seorang pegawai untuk meninjau hartanah berkenaan dan mengemukakan laporan, namun defendan membantah. Hakim menolak bantahan itu dengan merujuk empat penghakiman terdahulu yang kemudian didapati semuanya dijana AI. Defendan mencabar perintah itu di mahkamah tinggi negeri dengan menegaskan rujukan yang dipetik adalah palsu. Mahkamah tinggi mengakui perkara itu, namun menerima bahawa hakim junior tersebut melakukan kesilapan secara niat baik dan tetap bersetuju dengan keputusan mahkamah perbicaraan. Bagaimanapun, apabila kes dibawa ke Mahkamah Agung, pendekatan lebih tegas dikenakan. Pada Jumaat lalu, mahkamah tersebut menggantung perintah mahkamah rendah dalam pertikaian hartanah tersebut. Ia menyatakan penggunaan AI dalam membuat penghakiman bukan sekadar kesilapan membuat keputusan tetapi satu bentuk salah laku. “Kes ini menimbulkan kebimbangan institusi yang besar, bukan kerana keputusan substantifnya, tetapi berkaitan proses pengadilan dan penentuan,” kata mahkamah itu. Mahkamah turut mengeluarkan notis kepada Peguam Negara, Peguam Cara Negara serta Majlis Peguam India untuk meneliti isu tersebut dengan lebih mendalam. Bulan lalu, Mahkamah Agung juga menyuarakan kebimbangan terhadap trend peguam menggunakan alat AI untuk merangka petisyen, menyifatkannya sebagai tidak wajar.-AGENSI
