It comes amid accusations that the first-term Republican from Georgia aided participants in the Jan. 6 Capitol riot, which lawyers bringing the case call an act of insurrection.
The issue rests on Section 3 of the 14th Amendment, which stipulates that no one may be elected to public office who"shall have engaged in insurrection or rebellion against the" United States or has"given aid or comfort to the enemies thereof." Greene's opponents interpret some of her comments about the Jan. 6 riot as falling within these parameters.
Following the hearing, Judge Charles Beaudrot from the Office of State Administrative Hearings for the State of Georgia will make a recommendation to Georgia Secretary of State Brad Raffensperger on Greene's eligibility. Similar efforts to bar Republican Reps. Madison Cawthorn of North Carolina and Jim Banks of Indiana from the 2022 ballot have failed.
