WILLIAMSPORT – A federal judge has found that the former director of Penn State’s pesticide safety education program was fired for violating policies.

Kerry Richards was not a victim of age discrimination, U.S. Middle District Judge Matthew W. Brann ruled Tuesday in granting the university’s motion for summary judgment.Richards, who had been employed by Penn State since 1989, was 55 when terminated July 29, 2016, after being placed on unpaid administrative leave five months earlier.

Instructing student wage employees to submit an additional eight hours on their timesheets in order to reward them for exceptional work on a project. Awarding four hours of compensatory time for overnight stays required by travel time by both exempt and non-exempt employees. Failing to report that she had lost her Penn State-issued laptop at the time it was lost, reporting it only months later after inquiry during the audit.She cited the testimony of a human relations representative that Penn State did not consider it to be discrimination if treatment of men engaged in the same conduct were treated differently.and punitive damages along with front and back pay.
