USCIS has caused turmoil by announcing new procedures just before the H-1B filing deadline. It is likely to harm international students.
The new set of procedures announced by USCIS is throwing many law offices with business clients into turmoil. “By waiting until the last minute to announce that some, but not all, H-1B petitions can be premium processed, the Service has sent users of the program into chaos just two weeks before the filing deadline,” said William Stock, a founding member of Klasko Immigration Law Partners, LLP, in an interview.
Ironically, the impact will be most felt by those intended to benefit from the new procedures USCIS is implementing to choose H-1B visas during the lottery selection process: international graduate students. “The beneficiaries of the H-1B petitions – most of them graduates of U.S. university programs – would much prefer to have their petitions filed with premium processing in the initial package, because premium processing results in an emailed petition receipt,” said Stock.
Other immigration attorneys see the same problem. “I agree with Bill,” Dagmar Butte, partner at Parker, Butte & Lane, told me in an interview. “There will be thousands of cases that will have to be revisited by counsel to add the premium processing forms and checks and it will also add another layer to tracking these cases after submission. In addition, he is right that students prefer premium processing because it brings them peace of mind.” And the concern goes beyond peace of mind.
Butte is also concerned that the new USCIS H-1B Employer Data Hub is not the “good government” bid at transparency the agency advertises it to be in its statement. “The Data Hub, while it most certainly will contain useful information, will also stoke more anti-immigrant sentiment,” said Butte. “I am worried that it will cause people who do not know or understand the full story to focus negatively on companies who hire foreign nationals.
Today, employers view all administration actions on immigration through the prism of the past two years. Those years have seen rising denial rates, increases in Requests for Evidence and a score of policy actions designed to restrict high-skilled foreign nationals and others from working in the United States. Therefore, it is not surprising USCIS announced a new policy on short notice likely to make life more difficult for international students, H-1B visa holders and U.S. employers.
