“Rocky River Municipal Court” may be a bit of a misnomer. Many people don’t know that the court not only handles cases from Rocky River, but also from Bay Village, Fairview Park, North Olmsted and Westlake.
As a result, the court’s two judges have a big job – and one of them, Judge Donna Congeni Fitzsimmons, has reached the mandatory retirement age. Judge Brian F. Hagan is in the middle of his six-year term and won’t face re-election until 2025.
He also makes a point of saying he has “tried numerous civil and criminal cases in private practice.” Burke grew up in Bay Village and now lives with his wife, Michelle, and three daughters in Rocky River.“Why am I running for Rocky River Municipal Court judge? I am a skilled and experienced trial attorney, having tried numerous civil and criminal cases in my career, and have extensive appellate experience with over 20 reported cases,” Burke said.
“At this point in my career, I am less interested in accolades. Rather, I want to serve in order to utilize my skills and expertise to help others who do not have a voice in seeking justice by creating a level playing field. Kelly was the city prosecutor in Parma Heights from 2010 to 2018. Before that, he served three years with Cuyahoga County, 2003-2006, where he worked his way up to the general felony unit where he tried cases for drug possession, aggravated robbery and murder.Kelly also was an assistant law director for two years in Parma, a public defender from 2006 to 2008 in North Royalton and a municipal public defender in Brooklyn from 2018 to 2019.
Currently, Kelly is a Bay Village councilman-at-large. His term began in 2019 and expires at the end of this year. Kelly is married to Sarah, a public high school language arts teacher in Parma and yoga instructor.
