There are no easy solutions to the problem, but it is clearly a problem.
But to think about designing a specific proposal is to begin doubting the prospects of the enterprise. The Schiff-Johnson bill attempts to apply the term limits to sitting justices. It says that every few years, the most senior justice will be “deemed to have retired” to senior status. No way that’s constitutional.Democratic Rep. Ro Khanna would instead apply term limits only to new justices. He would have Congress createof life-tenured federal judgeship.
Maybe it could be made more palatable: Democrats could expand the Supreme Court, perhaps temporarily, at the same time they create the new term-limited positions. That way, they would not have to sacrifice their influence on the bench to get the reform.If Democrats expanded the Supreme Court to appoint new progressive justices, though, they would already have gotten what they wanted. Term limits would not give them anything extra.
