SEPTEMBER 29 ― The Private Member’s Bills of Datuk Seri Azalina Othman Said and four Pakatan Harapan MPs seeking to give Malaysian mothers the same rights as Malaysian fathers to pass on their citizenship to foreign-born children have been much lauded.I wrote that the Bills send a clear message to the government that the amendments to the Federal Constitution are as simple as inserting two words ― “or mother” ― to each of Clause 1 and Clause 1 of Part II of the Second Schedule.

In the same piece, I referred to Article 8 of the Federal Constitution which generally prohibits discrimination against a person or class of persons, unless there is a rational basis for such discrimination. The majority in the Court of Appeal on August 5 held that it was bound by the Federal Court decision, albeit by a majority, and therefore allowed the government’s appeal to overturn the High Court’s ruling allowing children born overseas to Malaysian mothers with foreign spouses to get Malaysian citizenship.
