Texas has finally made available free, DIY legal will forms that can be filled out, printed and signed.Q: Back in 2015, you mentioned that the Texas Supreme Court was working on free, do-it-yourself will forms. What is the status of these forms? The wills come in four versions. One is for a person who is not married and has children. Another is for a person who is not married and has no children. The third is for a married person with children.

First, the forms are not for everyone. If you don’t fit into one of the four available versions, you should not use the fill-in-the-blank forms. Instead, you should hire a lawyer. For instance, you might be unmarried with children, but you may not want to give them anything, or you might want to give half of your estate to one child and half to a nephew.

Second, and most importantly, even though you are now able to create your own will without having to pay a lawyer, the person you name as executor of your estate will still need to go to court and probate your will after you have died . Most of the time, this means hiring a lawyer and paying many thousands of dollars in legal fees, plus about $500 in court costs and other fees.

The information in this column is intended to provide a general understanding of the law, not legal advice. Ronald Lipman of the Houston law firm Lipman & Associates is board-certified in estate planning and probate law by the Texas Board of Legal Specialization. Email questions to: [email protected].
