To sidestep potential violation of federal anti-discrimination laws, or risk the loss of federal or philanthropic funding to Texas universities, the bill does make an exception and allows grant applicants to write about how their institution supports first-generation college students, low-income students or underserved student populations, if asked about diversity in their research.
Rather than a sweeping ban, legislators should have taken a beat to think. DEI policies can be helpful in ensuring institutions work to serve people from marginalized backgrounds, even as they can be amended to avoid abuses that can include evaluation based on narrow judgment of faculty, staff or students’ statements or actions.
They could have taken a similar approach to DEI, and identified what specific policies and practices of these offices need to be adapted.
