Some district attorneys across Texas have decided not to prosecute abortion-related crimes. This comes after the Supreme Court overturned Roe v. Wade.
, Dallas County DA John Creuzot said in part: “I want women across Texas, and especially here in Dallas County, to rest assured that my office will not stand in the way of them seeking the health care they need.” Other district attorneys say they will enforce abortion laws.And José Garza, the district attorney in Travis County, said, “We will not criminalize personal health care decisions.”
Oppositely, Tarrant County District Attorney Sharen Wilson said she will prosecute abortion-related crimes.tweetMaureen Farrell, a partner at TexanLegal.com, said there aren’t currently laws in place criminalizing women seeking an abortion. The burden falls on abortion providers. “It is absolutely fine for a district attorney to have a policy or to make a decision not to criminally prosecute a woman for seeking an abortion, someone for helping her get an abortion, or an abortion provider,” said Farrell.
Many abortion providers in Texas have already stopped operating. That’s because doctors can face fines and felony charges if they provide an abortion. Unless a doctor takes a risk and continues giving women abortions, district attorneys in Texas might not see many abortion-related crimes anyway.
