Texas, long been known as the nation's death penalty capital, has already executed one man this week. A second is scheduled for Thursday.

Texas DA stuns lawmakers as he refuses to stop Lucio execution

Rep. Joe Moody, D-El Paso, authored the bill that would give Texas prosecutors more authority to cancel scheduled executions, prompted by appeals filed on behalf of Melissa Lucio and John Ramirez, two high profile Texas death row defendants who made national headlines last year. Nevertheless, Lucio's execution was later stayed by the Texas Court of Criminal Appeals and her case was sent back to Cameron County court to weigh her claims of innocence.

Another of Moody’s bills, which passed the House last session 144 to 1 but didn’t receive a vote in the Senate, would allow new science to be applied to change the sentences of already convicted people. Rep. Jeff Leach, a Plano Republican, said during the hearing he was working with the Senate to get the bill passed.

“This will create a lot of clarity and certainty into an arena that’s been litigated already,” Moody said of his bill. Although her bill would not be retroactive, she invoked the case of Andre Thomas as an example of the problem she hopes to fix.
