“On the law, we were always very optimistic because we knew we were right. And on the facts we knew we were right,” said Paxton, a Republican. “The challenge is how much is it going to cost and where are you at litigating it? If we were in Collin County, my home county, we would have a whole different assessment.”

“If you’re in the wrong court, we know what happens, you’re going to lose,” Paxton told radio host Mark Davis. “People have political views that override the legal views. If I was confident that the court system would look at this from a legal perspective and say, ‘we’re going to make our decision based on the law and the facts,’ then I would absolutely fight this to the bitter end, despite the cost.

An attorney for the whistleblowers – who are former Deputy Attorney General for Criminal Justice Mark Penley, former Deputy AG for Legal Counsel Ryan Vassar, former Deputy AG for Policy and Strategic Initiatives James “Blake” Brickman and former Director of Law Enforcement David Maxwell – declined to comment.
