decision of 2013, Roberts reasoned that racism had so diminished in America that the federal government no longer needed to"pre-clear" changes to voting rules in jurisdictions with a history of discrimination. Those days, he seemed to think, are over.

Black residents make up 27 percent of Alabama's population, according to the latest Census, but they're a majority in only state's seven congressional districts. The ruling upheld Section 2 of the Voting Rights Act, which bars election practices that result in a denial of the right to vote based on race. In effect, the Court now requires Alabama to re-draw its congressional districts.

The court's ruling could lead to two new districts in Alabama with slimmer Black majorities, and will enable minority voters to challenge racial gerrymanders in states such as Louisiana and Georgia, where the redrawing of congressional maps was on hold pending the decision in the Alabama case. Roberts' willingness to recognize the deep political disadvantage for Black voters in Alabama does not necessarily mean that he believes similar levels of discrimination exist elsewhere in the country. In a past Voting Rights Act case, the court established a strict three-part test for determining whether a map violates the law: The minority group has to be geographically compact, political cohesive and consistently thwarted by the majority in electing their preferred candidate.
