He said his right foot became stuck on the accelerator, and that he used his left foot to brake but the vehicle didn’t stop.
He told police he had no medical issues that would impair his ability to drive and he had not consumed alcohol or drugs. A preliminary breath test showed a reading of 0.00%, according to court documents.
The SUV jumped a curb and drove 10 yards across a sidewalk seating area before going through the store’s glass front.Rein was previously arraigned in district court. Not guilty pleas were entered on his behalf and he was released on $100,000 bail.The district attorney’s office did not explain why Rein was charged with murder.
Rein has no criminal record in Massachusetts. In 2020, he was charged with driving under the influence in Vermont, but that violation was expunged. Some of the injured victims have sued Rein, Apple and the company that manages the shopping center, 15 miles southeast of central Boston. Their complaint alleges the store’s owners and operators were partly responsible because they failed to install bollards or other barriers between the parking lot and the storefront.
