As'aari Muhammad, son of Al-Arqam sect founder, pleaded not guilty to attempting to insult Islam in a Melaka Syariah High Court.
A son of Al-Arqam sect founder, As'aari Muhammad or 'Abuya', pleaded not guilty at the Melaka Syariah High Court on charges of attempting to insult Islam . According to the charge, Muhammad ‘Athoullah As’aari, 39, was found to be in possession of documents such as a book titled ‘ Islam ic Politics Brings Compassion’ and ‘Education of Rasulullah’ as well as a frame with As’aari's picture.
The offense was committed at a house in Jalan Ayer Molek Perdana 10, Taman Ayer Molek Perdana, Kuala Sungai Baru in Alor Gajah district, around 1:15 pm on September 21st. The accused was charged under Section 63 of the Syariah Offences Enactment (Melaka State) 1991, which is attempting to insult Islam by insulting a fatwa issued by the Mufti through the Gazette dated August 11, 1994 and the Gazette dated August 2, 2007. Meanwhile, his wife, Ummu Habibah Raihan, 41, was found to have abetted the offense committed by Muhammad ‘Athoullah by keeping the documents at the same location, date and time. In separate charges, the accused were found to have committed the offense under Section 37 of the Syariah Offences Enactment (Melaka State) 1991 read together with Section 63 of the same enactment, which is abetting in the offense of attempting to insult Islam by intentionally assisting her husband's unlawful act. Both accused face a fine of not exceeding RM5,000 or imprisonment for not exceeding 36 months or both. The prosecution by Chief Syariah Prosecutor of the Melaka Syariah Prosecution Department Atras Mohamad Zin proposed bail of RM1,000 over Muhammad ‘Athoullah, which was previously maintained and extended until the new date of trial, while Ummu Habibah was granted bail of RM3,000 or two guarantors. Lawyer Syarie Mohd Hafizuddin Ahmad Mispha and Mohd Faizal Mohamad, representing the accused, did not object to the prosecution's proposal
