The driver is expected to be arrested on suspicion of DUI and vehicular manslaughter.

Authorities identified the man killed in a traffic collision over the weekend when the driver of the sedan he was riding in crashed into a tree in East San Jose.

The man — identified as 38-year-old San Jose resident Richard Ortiz — was a passenger in a 2000 Toyota sedan in the crash that occurred at about 11:45 p.m., according to the San Jose Police Department. The driver was traveling north on South White Road when she went off the road near Castleton Drive and hit a tree.

Ortiz was pronounced dead after being taken to a hospital, according to police. The woman driving the car was also hospitalized. She was booked into the Santa Clara County jail on suspicion of vehicular manslaughter and driving under the influence in connection with the crash. The death marked the 14th roadway fatality of the year. Last year, 60 people died in crashes in San Jose, matching totals from 2015 and 2019. That total didn’t include a person who died in January of injuries sustained during a crash in October, because police count that death as part of this year’s number.
