Albert Herrera Jr. collapsed and died in front of a taco shop after being discharged
On behalf of their two children, a San Diego woman is suing Paradise Valley Hospital in National City, alleging that the medical facility, and several of its employees, should have done more to prevent the death of Albert Herrera Jr.
On Aug. 11, Herrera left the hospital and was found not long after collapsed in front of a local taco shop. He died shortly thereafter.into the death focused on paperwork and the proper medical classification of Herrera’s departure from the hospital, Hurtado has insisted that more should have been done to keep the father of her children in medical custody or, at the very least, in a family member’s company.
The lawsuit, filed this week, alleges that medical personnel failed to protect Herrera “from the danger he presented to himself and others, negligently allowing him to leave the hospital in a state of inability to protect himself from the imminent danger he was to himself and others.”“We continue to express our deepest condolences to the family of Mr. Herrera Jr.,” a company spokesperson said in an email.
