Republican states are gearing up to fight President Biden's actions targeting fossil fuel power plant emissions in court, saying he lacks the authority to issue such regulations.

The Supreme Court also ruled in June 2022 that the Clean Power Plan was unconstitutional since Congress never granted the EPA the explicit power to issue such regulations.
