KUALA LUMPUR: The prosecution has not received a decision yet from the Attorney General on whether it will withdraw the case involving the late Tun Daim Zainuddin who was accused of failing to declare his assets.
According to a source, the Deputy Public Prosecutor would have to discuss with the Malaysian Anti-Corruption Commission first before coming to a decision on the matter. On Wednesday, MACC chief commissioner Tan Sri Azam Baki said that the Deputy Public Prosecutor would be deciding the next course of action after a discussion between both agencies, as the MACC was only responsible in the investigation.
On Jan 29, the former finance minister claimed trial at the Sessions Court here over his alleged failure to declare his assets. According to the charge sheet, Daim had intentionally given a written statement under oath that did not comply with the terms of notice under Section 36 of the MACC Act 2009, whereby he did not declare assets as stated in Appendix A.Under Section 36 of the MACC Act 2009, Daim faces imprisonment of up to five years and a fine not exceeding RM100,000, if convicted.
