PUTRAJAYA: The Court of Appeal was informed on Wednesday that the conduct of six former students of Universiti Pertahanan Nasional Malaysia , who tortured UPNM Naval Cadet Officer Zulfarhan Osman Zulkarnain, resulting in scalding burns covering 80% of his body from 90 instances of steam ironing, constituted an extreme act .
According to Mangai, former UPNM students, prosecution witness 24, Ahmad Senabil Mohamad, and PW25 Mohd Syafiq Abdullah were the eyewitnesses in this case. Their testimony indicated that the first to fifth respondents alternately pressed the steam iron onto the deceased, while the instruction to do so was given by the sixth respondent.
Mangai further contended that PW6, a forensic medical expert from Serdang Hospital, Dr Salmah Arshad, who conducted the autopsy on the deceased, stated that the scalding burns were the cause of death. Meanwhile, Muhammad Najib's lawyer Datuk Hisyam Teh Poh Teik, submitted that the trial judge had failed to appreciate his client's defence and did not consider the evidence of the 20th defence witness, Muhammad Alif Farhan Aerosni.
"Can pressing the iron once be categorised as a criminal act? If it was indeed done, it was done without intent," he said, adding that the 18-year sentence imposed on his client was excessive.
