The Malaysian news has been buzzing with the case of Deputy Superintendent Mohd Nazri Abdul Razak, a high-ranking police officer accused of hitting and killing 5th-grade student Muhammad Zaharif Affendi Muhd Zamrie. Recently, reports surfaced that the prosecution had closed the case, leading to confusion among the public. Lawyer Mufarwa Farid shed light on the situation, explaining the meaning of 'prosecution closing the case' and the subsequent steps in the legal process.

In December 2023, Malaysia was shaken by the news of the death of a 5th-grade student, Muhammad Zaharif Affendi Muhd Zamrie, who was allegedly hit by a high-ranking police officer , Deputy Superintendent Mohd Nazri Abdul Razak. Recently, the case has resurfaced after several news outlets reported that the prosecution had closed the case. This is because some individuals believe that the case has been dropped and the police officer has been released without further trial.

Lawyer Explains the Meaning of 'Prosecution Closing the Case' Following this, lawyer Mufarwa Farid clarified the meaning behind the term 'prosecution closing the case'. In a Facebook post, Mufarwa explained that prosecution closing the case means that the prosecution has completed calling witnesses to testify. 'After the prosecution closes the case, the court will direct the prosecution and the defense lawyers to file written arguments,' he said. 'This period for written arguments is between one and three months.' The court will then decide whether the accused person (OKT) needs to defend themselves. According to him, after the written arguments are filed, the court will decide whether the accused person (OKT) needs to defend themselves. 'If the court is satisfied with the prosecution's arguments, then the OKT must defend themselves, if the court is not satisfied, then the OKT can be acquitted. 'If the OKT needs to defend themselves, then the OKT will need to call their own witnesses. For example, the wife, members of the public, or police officers themselves. This time, we call it as 'the defense case',' he said. According to him, after the defense witnesses have been called, the defense lawyer must then close the defense case. The court will then direct the lawyers and the prosecution to file further written arguments within a period of one to three months. 'After the written arguments are filed, the court will give a decision on whether the OKT is guilty or not. This is when the OKT will know whether they are acquitted or found guilty and will be sentenced. 'Whatever it is, don't think otherwise, yes. Closing the prosecution case does not mean dropping the case. We have two stages of the case, namely the prosecution case and the defense case (if any). 'And now, closing the prosecution case means that the first stage has just been closed,' said Mufarwa.
