The Pa. Supreme Court affirmed a 2020 decision by the Pa. Superior Court to give Akim Sharif Jones-Williams a new trial due to issues with the legality of the blood testing done in the case.

The Pennsylvania Supreme Court has affirmed a lower court’s decision to order a new trial for a central Pa. man who was convicted of homicide by vehicle for a car and train crash that killed his fiancee.

the Pa. Superior Court ordered a new trial saying the blood sample should never have been taken by police from the hospital without Jones-Williams’ consent or a search warrant.Jones-Williams was sentenced to 4 to 8 years in prison in 2017. The police could not get consent for the blood draw because Jones-Williams was in and out of consciousness while being treated and the officer retrieving it did not get a search warrant for the hospital sample.

Pointing to the testimony of the officer that took the blood, Mundy wrote that the officer went to the hospital with the intention of getting Jones-Williams’ consent and that he filed paperwork to request that the hospital transfer the sample in accordance with a different statute from the state’s “implied consent” rule.
