KUALA LUMPUR: Mukhriz Tun Mahathir, the President of Pejuang Tanah Air (Pejuang), has successfully postponed the payment of additional tax amounting to over RM5 million to the Inland Revenue Board (LHDN). This postponement is granted until April 16th, when the High Court here will hear Mukhriz's application to suspend the payment until his judicial review application regarding the additional assessment is decided. The amount represents the additional tax assessment for the period 2017 to 2019.

During yesterday's proceedings, High Court Judge Datuk Amarjeet Singh also granted permission to the former Kedah Menteri Besar to challenge the additional assessment calculation. Judge Amarjeet made the decision after finding that there were issues that could be discussed in the judicial review application. According to the judicial review application filed on December 20th, Mukhriz named the Chief Executive Officer or Director-General of Inland Revenue, Finance Minister, Datuk Seri Anwar Ibrahim, and the Malaysian Government as the first to third respondents. Among the reasons stated in the application, Mukhriz stated that the first respondent made a wrong assumption in taking into account expenses without the applicant's explanation as his other income. He alleged that LHDN incorrectly and arbitrarily took into account the disposal of the applicant's (Mukhriz) shares in OPCOM Holdings Berhad and the receipt of dividends from M Ocean Capital Sdn. Bhd. as expenses that could be taxed, whereas the disposal of shares and the receipt of dividends are non-taxable income. Mukhriz said, the first respondent's action in taking into account non-taxable income as taxable income is unfair and unequal because according to the first respondent's own statement, dividend income from shares and sales proceeds from shares are considered as non-taxable income
