Leading defamation barrister Matt Collins, KC, has emerged as a serious contender to be the next chief justice of the Federal Court, one of the most coveted and influential judicial positions in Australia,

“The chief justice is still serving ... I think that making an announcement a good time before the current chief justice retires, but not too long before his retirement, is appropriate.”The court is the final avenue for litigants in the federal system before the High Court. It is the national commercial court and the preferred forum of the Tax Office and regulators such as the Australian Securities and Investments Commission and the Australian Competition and Consumer Commission.

After three recent appointments, it will have 54 judges early next year. They do a mix of trial and appellate work and the chief justice is the ultimate arbiter of who sits on which cases. In the absence of someone of similar stature, Dr Collins is regarded as the most likely outsider. Like Justice Mortimer, he comes from Victoria, Mr Dreyfus’ home state, and has been head of both the Victorian Bar and the Australian Bar Association.
