OPINION: Judges are increasing fines to deter that CFMEU’s flagrant abuse of the law to empower itself. That’s the same union the ALP takes money from.
Like giving up on reforming an incorrigible offender, the Federal Court has jacked up an earlier fine on the CFMEU for an illegal picket in Canberra
According to Justice Anna Katzman, the blockade “illustrates a pattern of behaviour in which the union acts as if it is above the law” without contrition or correction.The fines add to the $16 million rap sheet since 2016 alone, for constant threats, slurs and intimidation towards other workers, employers and regulators.
Judicial penalties are no longer expected to chasten the CFMEU; they are simply an effort to make it too expensive for the union to carry on with this above-the-law business model. The High Court itself has ruled in a CFMEU case that proportionality to the actual offence does not matter in civil cases; it’s the deterrent that’s important. Nothing demonstrates that better than this union’s chronic law-breaking habit., which has provided some industry protection from the union thuggery. This needs to be scrutinised by the new National Anti-Corruption Commission.
