Fair Work has referred the hospitality giant executive to the AFP for allegedly lying about an agreement that deprived hundreds of workers of penalty rates.

The human resources chief of hospitality giant Mantle Group has been referred to the Australian Federal Police for allegedly lying about a workplace agreement that deprived hundreds of staff of their penalty rates.

But last month a full bench, led by acting president Adam Hatcher, found Mr Latham deliberately misled the commission about the agreement to get it approved, including how many workers would be covered and meetings held that the bench found never happened. She said Hot Wok had “received advice from a leading barrister that the statements from the FWC are erroneous and there is no basis to assert that Mr Latham has committed any offence or has otherwise acted inappropriately”.“Hot Wok is confident all decisions of the FWC will be quashed by the Federal Court after it hears Hot Wok’s application that the FWC was biased.”
