In organised crimes, the crimes are not random, unplanned, individual criminal acts. Instead, they are planned, rational acts that reflect the effort of groups of individuals. Its continuing existence is maintained through corruption of public officials and the use of intimidation, threats or force to protect its operations.
When organised crimes operate in two or more countries, they become transnational. This flows from the definition of transnational crime by the United Nations in 1995 — transnational crimes are offences whose inception, perpetration and/or direct or indirect effects involve more than one country. Article 2 defines the term as “a structured group of three or more persons, existing for a period of time and acting in concert with the aim of committing one or more serious crimes or offences established in accordance with this Convention, in order to obtain, directly or indirectly, a financial or other material benefit”.
