A 21-member committee of law experts, including judges and academics, has been established to review and amend the Contracts Act 1950 in Malaysia. The committee has a two-year mandate to propose changes based on recent developments in contract law and key court decisions. The last amendment to the Act was in 1976, making it outdated to address modern issues such as e-commerce and digital contracts.
PETALING JAYA: A committee of 21 law experts including judges has been formed to study and make amendments to the Contracts Act 1950.
According to a statement by the Prime Minister’s Department’s legal affairs division, the committee comprises judges, legal practitioners, civil servants and academicians.The department said the proposed changes to the Act would be made based on contract law developments and key court decisions related to the law.
The committee has been given two years to carry out the study and propose amendments needed for the Act. The department said amendments to the Act was last made in 1976 deeming it outdated as new matters such as e-commerce and digital contracts are not stipulated in it. Among the 21 members of the committee are former chief judge of Sabah and Sarawak David Wong, Court of Appeal judges Azizul Azmi Adnan and Wong Kian Kheong, as well as Asian International Arbitration Centre director, former apex court judge Mary Lim, also on the panel are Sarawak’s state legal adviser Fong Joo Chung, constitutional law expert Philip Koh and academics from Monash University, Universiti Kebangsaan Malaysia, as well as Universiti Sultan Zainal Abidin.
