A former Northwestern University cheerleader is right to allege that sex trafficking and other alleged misconduct constitute a breach of contract.

Last year, a former Northwestern University cheerleader, Hayden Richardson, filed a lawsuit alleging that Northwestern’s cheerleaders were subjected to groping, harassment and sexual touching by alumni donors and intoxicated football fans and that Northwestern made succumbing to such conduct a condition of their athletic scholarships. Richardson further alleged that when she complained, Northwestern did not follow the procedures set forth in its sexual harassment policy.

Richardson has alleged that university employees enabled such harassment and required submission to it. Moreover, Richardson has alleged that the university disingenuously labeled her a witness instead of a complainant in order to deprive her of procedural rights. Yet, even if university policies do not constitute an express contract, they establish an implied one.
