FOX LA's Elex Michaelson tweeted on Tuesday:"WON'T face criminal charges related to @alexdatig's allegations he brandished a gun at her . Elder, who is seen as the leading contender to oust Newsom in the recall election scheduled for September 14, had previously denied Datig's allegation.
