Lake County Council bucks setback amendment from Plan Commission

A partisan divide on the Lake County Council forced a recommended amendment to the new Unified Development Ordinance back to the Plan Commission for reconsideration.

Democrats on the council Tuesday rejected the amendment to the UDO brought forth by Councilman Randy Niemeyer, R-Cedar Lake, after a confusing explanation by the attorneys of what the council could do and when they needed to do it by to achieve the outcome they desired.The council had the option to approve the amendment, take no action, or reject the amendment with a reason provided to the plan commission, according to council attorney Thomas O’Donnell.

Niemeyer’s initial motion failed 2-4-1 along party lines, with Council President Charlie Brown, D-Gary, absent after he failed to garner support from his Democratic colleagues. A motion to reject the amendment passed 4-2-1, as Democratic officials stood behind the Planning Department director’s recommendations.

Ned Kovachevich, Director of the Plan Commission, opposed the amendment and argued against its passage. He said relief to property owners for the concerns raised by Niemeyer are already in statute. He questioned the need to write legislation to deal with a small number of incidents when redress is already available to those property owners.

Acting Council President Christine Cid, D-East Chicago, said she was disappointed she did not have more information before being asked to vote. She said she missed the meeting where the UDO was approved and has not had the chance to get up to date. She said the amendment presented by Niemeyer today is far more detailed than the short paragraph originally proposed in April. She said she is not sure she understands the ramifications.
