Labuan FSA Passes Four Bills to Enhance Transparency and Conform to International Standards

The Labuan FSA has announced that four bills related to the Labuan International Business and Financial Centre (Labuan IBFC) have been passed by Parliament. The bills, presented by Deputy Finance Minister Lim Hui Ying for their third reading in the Dewan Negara, aim to amend the Labuan Companies Act 1990, Labuan Trusts Act 1996, Labuan Foundations Act 2010, and Labuan Limited Partnerships and Limited Liability Partnerships Act 2010. The main objective of the amendments is to increase transparency and align with international standards set by the Financial Action Task Force (FATF) on Anti-Money Laundering and Combating the Financing of Terrorism (AML/CFT) concerning Beneficial Ownership (BO). The amendments also aim to fulfill Malaysia's commitment to complying with international tax compliance standards set by the Organisation for Economic Co-operation and Development (OECD).

PETALING JAYA: Pihak Berkuasa Perkhidmatan Kewangan Labuan mengumumkan bahawa empat rang undang-undang berkaitan dengan Labuan IBFC telah diluluskan di Parlimen baru-baru ini.

Ia juga untuk memenuhi komitmen Malaysia dalam mematuhi piawaian pematuhan cukai antarabangsa yang ditetapkan oleh Organisasi Kerjasama Ekonomi dan Pembangunan . “Selain itu, BO diwajibkan untuk mengisytiharkan status mereka kepada entiti Labuan, entiti Labuan perlu memastikan daftar yang tepat dan terkini dikekalkan, entiti Labuan dikehendaki untuk mengemukakan maklumat BO yang tepat dan terkini kepada Labuan FSA dalam tempoh yang ditetapkan serta sebarang perubahan kepada maklumat tersebut,” katanya dalam kenyataan.

“Pindaan ini dilakukan kerana terdapat undang-undang cukai sedia ada yang dengan secukupnya menangani perkara tersebut, iaitu pendapatan yang diperoleh daripada harta di dalam Malaysia adalah tertakluk kepada cukai di bawah Akta Cukai Pendapatan 1967 , pendapatan yang diperoleh daripada harta di luar Malaysia termasuk Labuan adalah tertakluk kepada cukai di bawah Akta Cukai Aktiviti Perniagaan Labuan 1990 ,” katanya.
