A judge has rejected Network Ten presenter Lisa Wilkinson's application to access phone records of Bruce Lehrmann, the man previously accused of raping Brittany Higgins, calling it a 'fishing expedition'.

The former Liberal staffer is suing Network Ten presenter Lisa Wilkinson and news.com.au political editor Samantha Maiden, along with their respective media outlets, for defamation.

Wilkinson experienced a legal setback on Thursday when the judge dismissed her application for access to Mr Lehrmann's phone records dating back to 2017, calling it a"fishing expedition."The preliminary hearing is considering whether Mr Lehrmann should be given special permission to proceed given he waited almost two years to take action over the two interviews, which is beyond the 12-month time limit for defamation cases.

Brittany Higgins claimed in the interviews that Mr Lehrmann raped her in the office of their then boss, former defence minister Linda Reynolds, in March 2019. Mr Lehrmann has always asserted his innocence and the charges have since been dropped. In these proceedings, Mr Lehrmann is arguing he was identifiable in the interviews, despite not being named., but had received legal advice to wait until after any criminal proceedings were finished.The hearing in Sydney's Federal Court continues.
