A jobless Malaysian man was sentenced to one year in prison for trespassing and damaging his ex-girlfriend's house after a misunderstanding between them.
A jobless man was jailed for a year by the Ampang Magistrate's Court today after pleading guilty to trespassing and breaking the glass door and doorknob of a house inhabited by his ex-girlfriend due to a misunderstanding between them. Magistrate Amalina Basirah Md Top handed down the sentence on Mohd Imran Othman, 32, and ordered the accused to begin serving his sentence from Sept 25 when he was arrested.
The man was charged with trespassing by entering the house belonging to his ex-girlfriend's father in Taman Melawati at 1.30 pm on Sept 18, according to Section 448 of the Penal Code which provides for a maximum prison sentence of three years or a fine of up to RM5,000 or both. Mohd Imran was also charged with mischief by breaking the glass door and doorknob of the woman's house, causing a loss of RM41,580 at the same location and time, under Section 427 of the Penal Code which carries a sentence of not less than one year and a maximum of five years or a fine or both. Besides that, the accused was charged with behaving indecently towards the 24-year-old woman by making threats against her under Section 14 of the Minor Offences Act 1955, which carries a maximum fine of RM100. Earlier, Deputy Public Prosecutor Norhidayah Abdullah Sani asked the court to impose a severe sentence taking into account the offences committed by the accused causing trauma to the victim and the amount of loss suffered by the victim was substantial. Lawyer Nadia Irwanita Mohamed Rosli from the National Legal Aid Foundation pleaded for a lighter sentence on the grounds that the accused's guilty plea saved time and costs for all parties, besides the accused had shown remorse and the incident occurred due to a misunderstanding with his ex-girlfriend
