Minister of Domestic Trade and Cost of Living Datuk Armizan Mohd Ali stated that existing laws impose substantial penalties on individuals or companies misusing the halal logo. He emphasized that the fines, which can reach up to RM5 million for corporations and RM1 million for individuals, are intended as a deterrent against such practices. Armizan also explained the various regulations and penalties under the Trade Descriptions (Definition of Halal) Order 2011 and the Trade Descriptions (Certification and Labelling of Halal) Order 2011. He further indicated that the Ministry is open to constructive suggestions aimed at enhancing public compliance regarding halal logo usage.
SHAH ALAM: The penalties stipulated under existing laws for anyone misusing the halal logo are already substantial, said Minister of Domestic Trade and Cost of Living ( KPDN ) Datuk Armizan Mohd Ali. He said that according to the Trade Descriptions (Definition of Halal) Order 2011, a company can be fined up to RM5 million, while for individuals, the fine is not more than RM1 million or a maximum imprisonment of three years.
“Any party that makes representations that could mislead Muslims in the context of halal can be subject to these fines (if found guilty). “So if we look at it from the law standpoint, it is actually already high and hopefully can serve as a deterrent to them (misusing the halal logo),” he told reporters after officiating the National Young Entrepreneur Programme (PUM) at Universiti Teknologi Mara (UiTM) Shah Alam here today. Armizan said that for the regulations under the Trade Descriptions (Certification and Labelling of Halal) Order 2011, a company can be fined not exceeding RM200,000 for the first offence and not exceeding RM500,000 for the subsequent offence. He said that for individuals, the fine is not more than RM100,000 or a year’s imprisonment or both and for the subsequent offence, RM250,000 or five years imprisonment or both. Furthermore, Armizan said that KPDN is ready to consider constructive suggestions that can contribute to improving community compliance in addressing the issue of misuse of the halal logo. He said this when commenting on the proposal by Deputy Mufti of Wilayah Persekutuan Jamali Mohd Adnan for KPDN and the Islamic Development Department (JAKIM) to study the need to increase the amount of fines for misuse of the halal logo if the offence becomes increasingly rampant. Media previously reported that KPDN has opened an investigation paper against a sandwich factory in Sunway Damansara, Petaling Jaya for suspected misuse of the halal logo. In a statement on January 13, Chief Enforcement Officer Datuk Azman Adam said the case is being investigated under Section 4(1) of the Trade Descriptions Act 2011 and Section 8(a) of the Trade Descriptions (Certification and Labelling of Halal) Order 2011.
