FORMER Commission on Elections commissioner Rowena Guanzon filed on Tuesday a petition for review before the the Department of Justice on the decision of the Quezon City Prosecutor's Office to dismiss her cyber libel and unjust vexation charges against National Youth Commission chairman Ronald Cardema.The charges were dismissed by the Quezon City prosecutor's office in a resolution issued on September 12 for lack of probable cause.
'The undersigned finds no evidence that would constitute a prima facie case for the crimes charged against the respondent,' Assistant City Prosecutor Raphael Joseph Seares said in the resolution.Seares pointed out that while it is true that a finding of probable cause needs only to rest on evidence showing that a crime was likely committed, 'no such evidence exists that would endanger a well-founded belief that such crimes charged were in fact committed by the respondent.
