Police say they don’t know what else can be done to stop a former immigration detainee breaking the strict conditions of his release from custody.

Abdelmoez Mohamed Elawad is accused of twice allowing his electronic ankle bracelet battery to go flat.Elawad, who was born in Sudan and came to Australia on a humanitarian visa with his family in 2006, had been in detention since 2018 after the Department of Home Affairs cancelled his visa on character grounds.

Elawad, who followed proceedings with the help of an Arabic translator, spoke only to confirm he could see and hear the court and spent most of the hearing with his face in his hands. He is seeking to be released on bail under strict conditions. “There are no bail conditions that you can possibly put on Mr Elawad now. I base that solely on the evidence that is in front of us,” Lal said.Lal said Elawad had been provided money, accommodation and medical assistance since his release from detention. He was also getting help from service provider Life Without Barriers and the Australian Border Force.

It heard that during his interactions with police Elawad was initially compliant, but he had become more aggressive and resistant. He also faces charges of assaulting police and resisting an emergency service worker.
