Kelley initally had been charged with femicide, a hate crime in Mexico that carries a sentence of 40 to 60 years. It is unclear why prosecutors, whothat they believed this was an open-and-shut case, agreed to lower the charge. Calls to the central prosecutor for the Mexican state Baja California went answered, and an email to its media relations office was not returned. Kelley’s family in New Jersey could also not be reached.
“I wanted justice, but justice was not served in this whole process,” Montoya said through a translator in a Facebook call from his home in the central Mexican state of Hidalgo. “The judge, the prosecutor, even my daughter’s attorney all acted in favor of and not for her. I am very frustrated by all the corruption and the deception.
Several of Kelly’s friends and former teammates had said they were in the dark as to how Kelley, once described by former Rutgers head coach Eddie Jordan as basketball player who “personified what we want in a student-athlete,” ended up in Tijuana or the nature of his relationship with Montoya. “Once he left us, that was the last we heard from him,” Brad Wachtel, former Rutgers director of basketball administration, said last year.
