Chinese disposable e-cigarettes from Elf Bar remain widely available in the U.S. more than four months after U.S. health regulators moved to ban their importation.

Months after U.S. regulators tried to block imports of Elf Bar in May 2023, the top-selling Chinese disposable e-cigarette remains widely available thanks to a simple but effective tactic: a name change. The Food and Drug Administration considers the products illegal.
FDA's tobacco director, Brian King, said the agency is monitoring instances where companies try to avoid detection by changing their branding. Public records show how quickly Elf Bar was able to rebrand itself when the FDA announced its import ban in May. “These items may come in under other deceptive practices. They are mislabeled or bundled together with other items in a container,” said Rob Handfield, who studies global supply chains at North Carolina State University. “Customs and Border Patrol aren’t going to go and inspect the contents of every shipping container.”, the deadly opioid that now accounts for the majority of U.S. drug overdose deaths.
Recently the agency has targeted vape shops, gas stations and convenience stores that sell disposable e-cigarettes. Last month, the FDA said it would seek theunder its regulations, about $19,000 each, from 22 stores. Regulators sent another 170 warning letters to stores selling Elf Bar-related products.The FDA still hasn’t fully utilized its powers to seize inventory from stores and distributors that sell unapproved products, experts note.
