District attorney clears San Diego police, sheriff's deputies in two shootings, one of them fatal [Breaking]
The District Attorney’s Office said Friday it had cleared San Diego police officers and county sheriff’s deputies involved in two shootings early last year, including the fatal shooting of a liquor store robbery suspect in Logan Heights who pulled a replica gun on the officers.
In the second shooting, which occurred last year in El Cajon, a suspect who had been towing a stolen trailer was shot 16 times by deputies during a stop. An auto theft task force member was shot in the leg by friendly fire. Both the suspect and the officer survived. Video released by police shows Officers Michael Martinez and Michael Muniz getting out of their patrol SUV and speaking to Andrade, who reaches his jacket pocket and pulls out a pistol. He has a knife in his other hand.
“In viewing the incident from the perspective of an objectively reasonable police officer, Andrade’s possession of what appeared to be an operable firearm, taking a shooting stance, and pointing the gun directly at an officer, the officers had reason to believe Andrade posed an imminent threat of serious bodily injury or death to them,” the letter states.
The letter states that Deputy David Lovejoy turned onto Decker Street at Ballard Street and saw the white van.
