During a congressional inquiry on Tuesday, DBM Acting Director Perpetual Judea Quiazon told lawmakers that based on their records, "there is no authority for the transfer issued by the DBM."It was also found out during the hearing that then-DICT Secretary Manny Caintic pushed through with the transfer despite a legal opinion from the agency's legal team against it.

It was Northern Samar Representative Paul Daza who questioned Caintic why the agency went against the legal opinion of DICT's Office of Assistant Secretary to Legal Affairs , which stated that the agreement was ultra vires, or an act beyond what the law allows. In response, Caintic said, “I was given legal advice na ‘yung MMDA has the capability to do it. Ang aking hinihingi hindi ICT aspect, ang paghuhukay, the civil works. The civil works is gonna be a tremendous project management challenge sa Maynila. Kaya ‘yun ng MMDA.”which he earlier flagged for alleged irregularities.“The download was illegal and against the legal opinion of their own lawyer in DICT...

San Jose Del Monte Representative Florida Robes then announced that she touched base with former MMDA chairperson and now Department of Interior and Local Government Secretary Benhur Abalos, and that Abalos wants to have the P1.1 billion funding returned to the DICT.“If the former chair is already saying that you have to return that money, that only means he already sought legal opinion before saying so.
