Democrats are nervously awaiting a ruling by the Senate's referee on whether they can include protections for Dreamers in the $3.5 trillion reconciliation bill

Sen. Alex Padilla, D-Calif., said there is nervousness among immigration advocates and "justifiably so.""We've seen people try and come up short time and time again," adding that this is a unique moment that creates a "need to get this done through reconciliation."

"If you give legalization without border security, you have another run on the border," he said. "That would be the end of bipartisan immigration reform for a long time." Attempts under the last three presidents faltered, and the two parties moved further apart under former President Donald Trump — Democrats in a more pro-immigration direction, Republicans in an increasingly anti-immigration direction.

"Can't blame the other side for trying to use reconciliation as expansively as they want to," he told reporters on Tuesday. "That's always the temptation, the majority using the reconciliation process, but abiding by the ruling of the parliamentarian is essential to the functioning of the Senate."
